1. The agreement
Eklaysia is operated by Atain, a sole proprietorship of Thompson Cherian, based in Kerala, India (“Atain”, “we”, “us”). These terms govern use of the Eklaysia platform at app.eklaysia.com, the Eklaysia mobile app (Google Play package com.eklaysia.mobile), websites published through Eklaysia, and this site.
When an administrator creates an organisation workspace, they accept these terms on behalf of that organisation and confirm they are authorised to do so. When a member joins a church's workspace, they accept these terms for their own use, alongside any rules the church sets for its community. If you do not agree, do not use Eklaysia.
2. Accounts
- Provide accurate registration information and keep it current.
- Keep your credentials secure; you are responsible for activity under your account. Two-factor authentication is mandatory for organisation administrators.
- Persons under 18 use Eklaysia only through their church's supervised community, with guardian consent obtained by the church (see the Privacy Policy, section 5).
- Notify us promptly at info@thompsoncherian.com if you suspect unauthorised access.
3. Your organisation's data — the church owns it
Your church owns its data. All records an organisation keeps in Eklaysia — member profiles, giving records, accounts, messages, media, websites, registers — belong to the organisation. We claim no ownership. The organisation grants us a limited licence to host, process, transmit and display that data solely to provide the service, and it ends when the data is deleted.
As between the organisation and Atain, the organisation is the Data Fiduciary for its congregation data and Atain is its Data Processor. The organisation is responsible for having a lawful basis for the data it collects — including its members' consent, guardian consent for children, and compliance with its own statutory, safeguarding and denominational obligations. Export tools are provided in the product so an organisation can take its data with it.
4. Acceptable use
You agree not to:
- use Eklaysia for anything unlawful, or in breach of the Information Technology Act, 2000 or other applicable law;
- harass, abuse, threaten or defame others, or post content that is hateful, obscene, or harmful to children — child-safety violations result in immediate suspension and, where required, reporting to authorities;
- send spam or unsolicited bulk communications through the platform's messaging, email or WhatsApp features;
- upload malware, infringe intellectual-property rights, or misrepresent your identity or authority;
- probe, disrupt or overload the service, attempt to access another organisation's data, or reverse-engineer the platform;
- resell or white-label the service without our written agreement.
Organisations moderate their own communities; we may also remove content or suspend accounts where these terms or the law require it.
5. Plans and fees
- Free — ₹0, for small congregations, with plan caps.
- Standard — ₹1,499 per month.
- Premium — ₹3,999 per month.
Prices are in Indian Rupees, billed monthly, plus GST as applicable [GSTIN — to be added]. Current plan limits (members, storage, sites, modules) are shown on the pricing page and in the console. We may change prices or plan structures with at least 30 days' notice; changes apply from your next billing cycle. Fees are non-refundable except where the law requires. If fees go unpaid, we may downgrade or suspend the workspace after notice. Design-partner and beta arrangements are honoured as separately agreed.
6. Availability
We work to keep Eklaysia reliable, but the service is provided “as is” and “as available”, without a guaranteed uptime level. Maintenance, upgrades, factors outside our control, and resource-conserving measures (the service may pause during long idle periods and resume within moments of the next visit) can cause temporary unavailability. Organisations should maintain their own copies of critical statutory documents; Eklaysia's export tools make this straightforward.
7. Intellectual property
The Eklaysia platform, its software, design and branding are owned by Atain and protected by law. We grant organisations and their members a limited, non-exclusive, non-transferable right to use the service while these terms are in effect. If you send us feedback or suggestions, we may use them without obligation to you.
8. Third-party services
Parts of Eklaysia depend on third-party services — for example WhatsApp for one-time codes, Google for sign-in and push notifications, and LiveKit for video. Your use of those features is also subject to those providers' terms, and their availability is not within our control.
9. Privacy
Our Privacy Policy explains what data is processed, where it lives (India), and your rights — including the church-versus-Atain fiduciary split and children's protections. It forms part of these terms.
10. Termination
- By you: a member may delete their account at any time (see account deletion); an organisation may close its workspace at any time via its owner account or by written request.
- By us: we may suspend or terminate access for material breach of these terms, unlawful use, child-safety violations, non-payment after notice, or where the law requires.
- After closure: the organisation may export its data during a 30-day wind-down; we then delete the workspace's data within 90 days of closure, with backup copies aging out within a further 30 days. Records an organisation must retain by statute are its responsibility to export and keep.
- Sections 3 (ownership), 11 (liability) and 13 (law) survive termination.
11. Liability
To the maximum extent permitted by law: we are not liable for indirect, incidental, special or consequential losses, loss of profits, or loss of data caused by events beyond our reasonable control; and our total aggregate liability arising out of or relating to the service is limited to the fees the organisation paid to us in the 12 months preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under Indian law.
Eklaysia provides record-keeping and compliance tooling (such as 80G receipts, FCRA segregation and payroll computations); responsibility for the organisation's tax, FCRA and statutory filings remains with the organisation and its professional advisers.
12. Indemnity
An organisation will indemnify Atain against third-party claims arising from the organisation's content, its breach of these terms, or its failure to obtain the consents required for the data it keeps in Eklaysia.
13. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to any mandatory law to the contrary, the courts in Kerala, India have exclusive jurisdiction over disputes arising out of or relating to these terms or the service.
14. Changes to these terms
We may update these terms as the service evolves. Material changes will be announced in the console and app at least 15 days before they take effect, with the version number and effective date shown at the top of this page. Continued use after the effective date constitutes acceptance.
